NOBEL LAUREATES ISSUE APPEAL TO KOFI ANNAN AND THE UN OVER THE WESTERN SAHARA

Your Excellency Secretary- General Kofi Annan,

Dear President of the United Nations Security Council;

Western Sahara referendum is the only path to peace

First of all, allow us to congratulate you on being awarded the Nobel Peace Prize for 2001.

We the undersigned are deeply concerned by the lack of progress in the implementation of the referendum of self- determination in Western Sahara.

Western Sahara has now been under occupation by Morocco for 26 years. The occupation has caused enormous suffering for the Saharawi and Moroccan peoples, exile and loss of life, and scarce resources have been squandered through war and occupation.

The UN has since 1991 been mandated to organize a free, fair and transparent referendum in Western Sahara through UN SC Res. 690 of 1991. This was later reconfirmed in the 1997 Houston accords. UN GA Res. 1514 and 1541 (1960) and the ICJ advisory opinion in 1975 constitute the basis for this mandate. These resolutions and agreements provide both the necessary compromises between the parties and the legal basis and the mechanisms for the referendum. Despite this, recent developments indicate that the United Nations is on the verge of abandoning its earlier commitments and the signed agreements.

An abandonment of the referendum in Western Sahara would constitute a betrayal of the inalienable right of the Saharawi people to self- determination. It would also be a defeat for the United Nations' proud history of support for decolonization and respect for international legality.

The credibility of the United Nations is at stake in Western Sahara. We urge you to defend the integrity of the United Nations by continuing to strive for the strict implementation of the referendum as earlier agreed between the parties, as we believe that this is the only path to a durable and just peace in the Maghreb.

We also express our grave concern about the overwhelming presence of Moroccan troops and civilian settlers in occupied Western Sahara, the massive use of antipersonnel landmines, the constant harassment of Human Rights defenders, arbitrary detentions and violent suppression of dissent. We call for free access for independent observers and journalists and respect for the right to freedom of speech and assembly.

In view of Morocco's illegal contracts with US and French oil companies for the exploration for oil in occupied Western Sahara, we request the United Nations to do anything possible to safeguard the natural resources of the territory. For the UN to stand by whilst the natural resources of Western Sahara are exploited by Morocco could be interpreted as legitimizing Morocco's occupation of the territory.

We urge you to help ensure a timely, sustained and predictable supply of food and other necessary supplies to the Saharawi refugees in Algeria until their safe repatriation to Western Sahara under conditions acceptable to them.

We believe that the example of East Timor shows that even in the most difficult circumstances, a people that is united and organized is able to endure the most terrible times and fulfill the right to self-determination.

Le référendum est la seule voie vers la paix au Sahara Occidental

Tout d'abord permettez-nous de vous féliciter pour le prix Nobel de la paix 2001.

Nous soussigné-e-s sommes profondément préoccupé-e-s par le manque de progrès dans la mise en oeuvre du référendum d'autodétermination au Sahara Occidental.

Cela fait maintenant 26 ans que le Sahara Occidental est sous occupation marocaine. Cette occupation a causé d'énormes souffrances pour les peuples sahraoui et marocain, exil et pertes en vies humaines; des ressources précieuses ont été gaspillées par la guerre et l'occupation

Depuis 1991 l'ONU est mandatée par la résolution 690 du Conseil de sécurité pour organiser un référendum libre et régulier au Sahara Occidental. Cet objectif a été reconfirmé plus tard par les accords de Houston de 1997. Les résolutions de l'Assemblée générale 1514 et 1541 (1960) et l'avis consultatif de la Cour Internationale de Justice de 1975 sont à la base de ce mandat. Ces résolutions et accords comprennent les compromis concédés par les deux parties et fournissent la base légale et les dispositifs de mise en oeuvre du référendum. Malgré cela, les développements récents indiquent que les Natuons Unies sont en train d'abandonner leurs engagements antérieurs et les accords signés.

Un abandon du référendum au Sahara Occidental constituerait une trahison du droit inaliénable du peuple sahraoui à l'autodétermination. Il constituerait également une défaite pour les Nations Unies, dépositaires d'une riche histoire de soutien à la décolonisation et au respect de la légalité internationale.

La crédibilité des Nations Unies est en jeu au Sahara Occidental. Nous vous exhortons à défendre l'intégrité des Nations Unies en poursuivant vos efforts pour la mise en oeuvre stricte du référendum, comme convenu précédemment entre les parties, car nous croyons que c'est la seule voie menant à une paix juste et durable au Maghreb.

Nous vous exprimons aussi notre profonde préoccupation quant à la présence massive de militaires et de colons civils marocains au Sahara Occidental occupé, l'utilisation massive de mines antipersonnel, le harcèlement continu des défenseurs des droits humains, les détentions arbitraires et la violente répression de la dissidence. Nous appelons au libre accès pour des observateurs indépendants et des journalistes et au respect du droit à la liberté de parole et de réunion.

A propos des contrats d'exploitation pétrolière au Sahara Occidental, signés illégalement par le Maroc avec des compagnies pétrolières des USA et de France, nous demandons aux Nations Unies de faire tout leur possible afin de présrver les ressources naturelles du territoire. Pour les Nations Unies rester les bras croisés pendant que les ressources naturelles du Sahara Occidental sont pillées par le Maroc peut être interprété comme une légitimation de l'occupation marocaine du territoire.

Nous vous appelons instamment à veiller à ce que l'approvisionnement en nourriture et autres nécessités primaires des réfugiés sahraouis en Algérie soit livré de façon régulière, continue et fiable, jusqu'à leur rapatriement au Sahara Occidental en toute sécurité et à des conditions acceptables.

Nous croyons que l'exemple du Timor oriental montre que même dans les conditions les plus pénibles un peuple uni et organisé peut endurer des épreuves difficiles et réaliser son droit à l'autodétermination.
