L'état marocain a procédé à mon arrestation le 20 juillet 2005 en même temps que les militants sahraouis des droits de l'homme Elhoucine Lidri et Brahim Noumria qui ont été torturés par les tortionnaires marocains cités dans de nombreux témoignages durant et après la période de leur garde à vue. Cette arrestation a eu lieu après une irruption musclée de 8 membres du service de renseignements généraux dans la maison de la militante sahraouie Fatma Ayach le mercredi 20 juillet à 10h00 du matin.

J'ai été placé dans un bureau dans les locaux de la police judiciaire marocaine comme c'était le cas pour les deux militants sahraouis des droits humains Elhoucine Lidri (professeur de philosophie, ancien expulsé sahraoui vers le Maroc et membre du bureau du Forum Vérité et Justice section Sahara Occidental… etc) et Brahim Noumria (exprisonnier politique sahraoui en 1983, 1985, 1987, 1991, membre du Forum Vérité et Justice section Sahara, membre de l'AMDH… etc). Ces deux défenseurs des droits humains au Sahara Occidental ont été enlevés vers une destination inconnue où ils ont été sauvagement torturés et humiliés par des tortionnaires marocains connus au Sahara Occidental.

En ce qui me concerne, j'ai fait l'objet d'un long interrogatoire mené par cinq responsables marocains du service des renseignements généraux.

Avant de m'interroger sur mes activités en tant que militant sahraoui des droits de l'homme et aussi sur la nature des relations que je maintiens avec de nombreux militants sahraouis des droits de l'homme, ces cinq agents marocains m'ont traité d'agent de renseignements algérien suite à ma participation aux manifestations pacifiques qui ont eu lieu les mois derniers au Sahara Occidental.

Mes réponses étaient claires et je leur ai annoncé que je suis et je reste pour une solution démocratique incarnée dans un référendum libre et sous l'égide de l'ONU au Sahara Occidental. Une position claire qui a poussé ces cinq responsables marocains à s'acharner contre moi et à me menacer d'humiliation et de torture. L'interrogatoire a duré plusieurs heures et on m'a jeté comme un rat dans une petite cellule sâle et pleine d'insectes et de mauvaises odeurs.

Je suis resté emprisonné dans cette terrible cellule jusqu'à 1h00 du matin du 22 juillet 2005 et j'ai été conduit vers le siège de la Wilaya de la sûreté marocaine à Lâayoune/Sahara Occidental en compagnie des deux militants sahraouis des droits de l'homme (arrêtés le même jour) : Mohamed Elmoutaoikil (exprisonnier politique sahraoui en 1992, expulsé sahraoui vers le Maroc et membre du bureau exécutif du Forum Vérité et Justice) et de Mohamed Fadel Gaoudi ( exprisonnier politique sahraoui en 1978, cadre bancaire et membre de l'AMDH).

Après, on a été transporté vers le tribunal de seconde instance de Lâayoune/Sahara Occidental où on a été présenté au procureur du Roi du Maroc et j'aimerais bien signaler que le procureur adjoint du Roi du Maroc a profité de cette occasion pour m'interroger une deuxième fois et de me demander de renoncer à ma position stable envers mon peuple sahraoui. Ce procureur adjoint de son Roi du Maroc m'a promis un travail et des avantages si je renonce à mes positions politiques concernant l'affaire du Sahara Occidental, quelque chose que j'ai refusé et rejeté catégoriquement.

On a été ensuite renvoyé vers le siège de la Wilaya de la sûreté marocaine où on est resté jusqu'à 7h00 du lendemain matin avant d'être transporté encore une deuxième fois vers le bureau du procureur général au tribunal de seconde instance de Lâayoune. On est resté presque 15 heures dans le siège de ce tribunal avant qu'on soit présenté au procureur général qui a confirmé la libération de Mohamed Fadel Gaoudi et le transferts de mon dossier ainsi que les dossiers de Elmoutaoikil, Noumria et Lidri au juge marocain d'instruction. Des dossiers qu'on n'a jamais consultés et qui ont été montés de toutes pièces par la Police judiciaire marocaine en complicité avec la justice marocaine dans le but de freiner nos activités en tant que militants sahraouis et défenseurs des droits de l'homme favorables pour l'organisation d'un referendum libre, démocratique et sous l'égide de l'ONU au Sahara Occidental.

The testimony of the Sahrawi human rights activist and the political prisoner, El Arbi Massaoud

The Moroccan authorities have arrested me together with the human rights activist, Elhoucine Lidri and Brahim Noumria on July 20, 2005 in El Ayun, Western Sahara, after the breaking into the house of the human rights activist and former disappeared, Fatma Ayache at about 10 a.m. GMT by 8 judicial police and The General Intelligence agents. The latter have abducted and tortured my comrades while in custody.

As we were taken to the judicial police center, we were separated to different offices to take our personal information, my comrades Lidri Elhoucine, a teacher of philosophy for high school students and a bureau member of the Forum for Truth and Justice, and Noumria Brahim, a former disappeared in 1983, 1985, 1987, 1991, 2005, Noumria is a baccalaureate holder, from Nuestra Senora del Pilar institute in Tetouan, Morocco. He is deprived of work. He is also a bureau member of the Forum for Truth and Justice and a member of the Moroccan association of human rights. They were both taken to unknown place in ambiguous conditions where they were subjected to all kinds of torture while I was being interrogated at the judicial police center without torture or threatening. I was interrogated on my relation to the huge peaceful demonstrations that took place in El Ayun, Western Sahara since May 21, 2005, and on my relation to a group of Sahrawi human rights activists as well as my position concerning the Western Sahara issue. They were trying to frighten me in order to give up my conviction that the democratic solution for the Western sahara issue is to organize a fair and free referendum under the supervision of the United Nations.

I was interrogated by five interrogators treating me as a spy for the Algerian Secret Services and that I represent a minority that have the same opinion, insisting on my human rights work and my participation in the protest sit-ins organized by the sahrawi citizens. The interrogation lasted until late at night, I spent the night in a dirty small cell, full of insects and bad smells. I stayed in the cell until the next day at 13:00 on July 22, 2005 when a police agent came to take me together with the other human rights activists, Mohamed Elmoutaoikil, a Secretary General of the Municipality of Ben Msik, Casablanca and a former political prisoner in 1992, a bureau member of the Forum for Truth and Justice, and Fdail Gaoudi, a dismissed bank high employee, a former political prisoner in 1977 and member of the national council of the Forum for Truth and Justice and the Moroccan association of human rights , who were abducted on the same day in Casablanca, Morocco. Then we were all taken to the central police station in El Ayun, then to the General attorney in the court of appeal who prolonged our custody. This prolongation was exploited by the vice-attorney to try to bribe me by offering job for me but I have to change my convictions , which I completely refused. I insisted that I will not change my thoughts upon the issue o Western Sahara. After that we were taken to the central police station again where I spent all the day until 07 in the morning of the next day. Then we were again taken to the court of appeal where we spent more than 15 hours. The General attorney listened to us and released Gaoudi Fdaili whereas ordered that we, the four of us, should be sent to the examining magistrate who charged us of many accusations in a file that we did not see at the judicial police center. We were astonished at the basis on which the examining magistrate built his accusations, and on which we are now at the political detention after firmly sticking to our opinions concerning the Western Sahara issue.
