As actual President of the Security Council, we would like to communicate to you a petition concerning the Western Sahara Conflict and the last report and proposals submitted by the Secretary General, M. Kofi Annan on this subject.

We will send you again our now updated new version signed by more and more european NGO's.

The members of the European NGO-Consortio having signed this petition, have been working in the Sahrawi refugee camps for many years - some of them since the beginning of the conflict, in 1975/76.

We would like to ask you, to communicate our petition to the members of the Security Council.

Having all our confidence in your well deliberated, responsible and prospective jugement, we would like to ask you not to sustain the proposals of Mr. James Baker and Mr. Kofi Annan, as far as the the idea of a partial - and non-acceptable from a Sahrawi point of view - autonomy is concerned. You will find our arguments in the attached statement.

Messieurs,

Le 22 juillet 2001, le Secrétaire Général des NU, Kofi Annan, a soumis au Conseil de Sécurité son rapport au sujet du conflit au Sahara Occidental, dernier conflit colonial sur le sol africain qui perdure depuis maintenant 26 ans. Dans son rapport, le SG favorise une proposition "d'accord cadre", visant un règlement d'autonomie partielle allant à la convenance des intérêts du Maroc, mais, qui &endash; au vu de l'histoire, de sa genèse et des principales prévisions de cette proposition - ne pourrait être acceptable pour les Sahraouis.

 Les ONG européennes qui se sont regroupées en Consortium travaillant aux campements des réfugiés sahraouis au sud-ouest de l'Algérie, pour une très grande partie depuis de très nombreuses années, si ce n'est même depuis le début du conflit, s'adressent aux membres du Conseil de Sécurité des NU ainsi qu'à leurs Etats membres respectifs, pour souligner le risque important de reprise des hostilités suite au contenu du rapport.

 1. Le conflit du Sahara Occidental est un conflit de décolonisation et doit être résolu comme tel par l'autodétermination du peuple sahraoui, droit reconnu par la "communauté internationale" depuis les années soixante et confirmé par avis consultatif de la Cour Internationale de la Haye en 1975.

2. L'histoire du peuple sahraoui est marquée par d'interminables souffrances aussi bien lors de leur expulsion du Sahara Occidental, que dans l'exil algérien que les Sahraouis ont dû subir dans des conditions de vie inhumaines en plein désert tout en attendant une solution pacifique, juste et durable du conflit, mais aussi sous la présence marocaine, dans des territoires où les Sahraouis souffrent à l'heure actuelle d'une brutale politique d'Apartheid et de violations des droits de l'homme. Le rapport du Secrétaire Général semble vouloir ignorer cette tragédie humaine et la volonté de paix de tout un peuple, en proposant une solution qui récompense l'oppresseur, en ignorant les droits fondamentaux et les intérêts légitimes des Sahraouis tout en leur demandant de se soumettre au Maroc, sans aucune garantie de sécurité. Au vu de ces expériences, le projet d'autonomie proposé doit être perçu comme une provocation de la part des Sahraouis.

3. L'acceptation définitive par le Conseil de Sécurité des propositions du Secrétaire Général sera perçue de la part de la « communauté internationale » comme une déclaration ouverte de faillite des NU et de ses instruments et comme une victoire des mesures militaires sur les principes du droit international, de l'autodétermination et de la solution pacifique des conflits politiques. Dans ce sens, l'impact négatif d'une tentative de « solutionner » le conflit du Sahara Occidental d'une manière allant à l'encontre de ces principes fondamentaux, risque d'avoir des effets allant largement au delà des frontières du Sahara Occidental.

4. Le SG ne manque pas de mentionner dans son rapport la situation humanitaire précaire des réfugiés sahraouis dans les campements près de Tindouf. Leur situation humanitaire s'est encore détériorée pendant les mois passés, suite aux restrictions financières dictées par des considérations d'ordre politique. Ainsi, notamment, la situation alimentaire des réfugiés sahraouis est très alarmante depuis plusieurs mois, suite à l'incapacité du Programme Alimentaire Mondiale (PAM) de garantir les aliments de base dont il a la charge et à l'annulation de l'aide alimentaire bilatérale de certains Etats. Suite à cette situation qui reflète la régression de l'engagement de la « communauté internationale », les réfugiés sahraouis se sentent aux campements considérés comme « laissés pour compte ».

5. L'ignorance des droits fondamentaux des Sahraouis, notamment de

vont à l'encontre du principe de la prévention des crises et de la désescalade des conflits, si souvent affirmé par les représentants des NU et des Etats.

 Nous, les ONG européennes préoccupées par le destin du peuple sahraoui et la paix au Maghreb, faisons appel aux membres du Conseil de Sécurité ainsi qu'à nos gouvernements respectifs afin qu'ils s'opposent fermement à cette capitulation sans condition et refusent avec l'appui de toute leur autorité, l'affaiblissement supplémentaire de l'ONU, de ses principes et de ses mécanismes ainsi que de sa crédibilité par une politique qui au lieu de servir le droit international sert les intérêts des puissants.

Dear Sir or Madam,

On 22 July 2001, the UN Secretary General, Kofi Annan, submitted to the Security Council his report on the conflict in Western Sahara, the last colonial conflict on African soil which has been going on for 26 years. In his report the Secretary General favours a proposed "Framework Agreement", aiming for a settlement of limited autonomy which suits Moroccan interests, but which, in view of its history, its origin and the principal provisions of this proposal could not be acceptable to the Saharawis.

European NGOs grouped together as a Consortium working in the Saharawi refugee camps in south-west Algeria, the majority for very many years, if not from the outset of this conflict, address the members of the Security Council of the United Nations as well as to their respective countries, to underline the great risk of resumption of hostilities due to the contents of the report.

The conflict in Western Sahara is a conflict of decolonisation and should be resolved as such by the self-determination of the Saharawi people, a right recognised by the "international community" since the sixties and confirmed through the consultative advice of the International Court of Justice in the Hague in 1975.

The history of the Saharawi people is marked by interminable suffering both from their expulsion from Western Sahara, and in their Algerian exile in which the Saharawis have had to undergo ininhuman living conditions in the middle of the desert while waiting for a peaceful, just and lasting solution for the conflict, but also under Moroccan occupation in the territories where the Saharawis suffer at the present time from a brutal policy of Apartheid and human rights abuses. The Secretary General's report seems to want to turn its back on this human tragedy and the desire for peace of a whole people, in proposing a solution which rewards the oppressor, while ignoring the fundamental rights and legitimate interests of the Saharawis by asking them to submit to Morocco without any guarantee of security. From the point of view of these experiences, the draft proposal for autonomy put forward should be perceived as a provocation to the Saharawis.

The definitive acceptance by the Security Council of the proposals of the Secretary General would be perceived by the "international community" as an open declaration of failure of the UN and of its instruments and as a victory for military measures over the principles of international law, of self-determination and of the peaceful resolution of political conflicts. In this sense, the negative impact of an attempt to "solve" the conflict of Western Sahara by going against these fundamental principles, is liable to have effects well beyond the frontiers of Western Sahara.

The SG does not fail to mention in his report the precarious humanitarian situation of the Saharawi refugees in the camps near Tindouf. Their humanitarian situation has deteriorated further in the past months, following financial restrictions dictated by poltical considerations. Thus, in particular the food situation of the Saharawi refugees has been very alarming for several months, following the incapacity of the World Food Programme to assure basic foodstuffs for which it is responsible and the cancellation of bilateral food aid of certain states. Because of this situation which reflects the way the "international community" has gone back on its commitment, the Saharawi refugees in the camps feel as if they have been left to their own devices.

Ignoring the fundamental rights of the Saharawis, in particular recognition of the injustice they have suffered and are suffering their right to self-determination their security their right to live in humane and dignified conditions goes against the priniciple of preventing crises and escalation of crises, so often affirmed by representatives of the UN and national governments.

We, the European NGOs concerned for the fate the Saharawi people and peace in the Maghreb, appeal to members of the Security Council as well as to our respective governments to oppose firmly this unconditional capitulation and to refuse, with the support of all their authority, the further weakening of the UN, of its principles and its mechanisms as well as its credibility by a policy which instead of serving international law, serves the interests of the powerful.

Estimado señor o señora:

El 22 de junio de 2001, el Secretario General de la NNUU, Sr. Kofi Annan, ha enviado al Consejo de Seguridad su informe relativo al conflicto del Sahara Occidental, último conflicto colonial sobre suelo africano que perdura después de 26 años. En dicho informe, el Secretario General apoya una propuesta que considera un arreglo de autonomía parcial, conveniente al reino de Marruecos, pero que &endash; a ojos de la historia, de los antecedentes y de las principales disposiciones de esta propuesta- nunca será aceptable para el pueblo saharaui.

Las ONG europeas que, agrupadas en Consorcio, trabajan en los campamentos de refugiados saharauis al sur-oeste de Argelia, la mayor parte desde hace muchos años o incluso desde el inicio del conflicto, se dirigen a los miembros del Consejo de Seguridad de las NNUU, así como a los Estados miembros respectivos, para significar el riesgo importante de reinicio de hostilidades como consecuencia del citado informe.

1. El conflicto del Sahara Occidental es un conflicto de descolonización y debe ser resuelto como tal por la autodeterminación del pueblo saharaui, derecho reconocido por la "comunidad internacional" desde los años sesenta y confirmado por la resolución consultiva del Tribunal Internacional de La Haya en 1975.

2. La historia del pueblo saharaui está marcada por interminables sufrimientos, no solo durante su expulsión de Sahara Occidental, como durante el exilio argelino que los saharauis han tenido que soportar en condiciones inhumanas en pleno desierto mientras esperan una solución pacífica, justa y perdurable del conflicto, sino también bajo la presencia marroquí en los territorios donde los saharauis sufren en la actualidad una brutal política de "apartheid" y de violación de los derechos humanos. El informe del Secretario General parece pretender olvidar esta tragedia humana y la voluntad de paz de todo un pueblo, proponiendo una solución que recompensa al opresor, ignorando los derechos fundamentales y los intereses legítimos de los saharauis, pidiéndoles someterse a Marruecos sin ninguna garantía de seguridad. Considerando estas experiencias, el proyecto de autonomía que se propone puede ser percibido por los saharauis como una provocación.

3. La aceptación definitiva por el Consejo de Seguridad de las propuestas del Secretario General será percibida por la comunidad internacional como una abierta declaración del fracaso de las NNUU y de sus instrumentos, y como una victoria de la presión militar sobre los principios del Derecho Internacional, del derecho de autodeterminación y de la solución pacífica de los conflictos políticos. En este sentido, el impacto negativo de una tentativa de "solución" del conflicto de Sahara Occidental de una manera contrapuesta a estos principios fundamentales, puede ocasionar efectos más allá de las fronteras de Sahara Occidental.

4. El Secretario General no deja de mencionar en su informe la precaria situación humanitaria de los refugiados saharauis en los campamentos próximos a Tindouf. Su situación humanitaria se ha deteriorado aún más durante los pasados meses, como consecuencia de las restricciones financieras dictadas por consideraciones de orden político. Así, principalmente la situación alimentaria de los refugiados saharauis es alarmante desde hace varios meses, debido a la incapacidad del Programa Mundial de Alimentos para garantizar los alimentos básicos de cuyo suministro es responsable y a la anulación de la ayuda alimentaria bilateral de algunos Estados. Como resultado de esta situación, que manifiesta una regresión en los compromisos de la comunidad internacional, los refugiados saharauis se sienten en los campamentos "abandonados a su suerte".

5. La ignorancia de los derechos fundamentales de los saharauis, principalmente:

se contradice con los principios de la prevención de crisis y de la solución de conflictos, tantas veces sostenidos por los representantes de las NNUU y de los Estados.

Nosotros, las ONG europeas preocupadas por el destino del pueblo saharaui y la paz en el Magrheb, hacemos un llamamiento a los miembros del Consejo de Seguridad así como a nuestros gobiernos respectivos para que se opongan abiertamente a esta capitulación sin condiciones y que rechacen, con toda su autoridad, el debilitamiento de las NNUU, de sus principios y de sus instrumentos, así como de su credibilidad por una política que, en lugar de servir al Derecho Internacional, sirve a los intereses de los más poderosos.
