The
Role and Responsibility of the International Community in support of a
resolution for the conflict of Western Sahara
I would like to thank the Ministry of Foreign Affairs of South Africa
as well as the University of Pretoria, which has taken the initiative
for this meeting, the subject of which is particularly topical.
Allow me to speak in my capacity as a militant for the right of peoples
to self-determination and to share with you my emotion because,
although I was a militant in the struggle against apartheid for more
than 30 years and still own the house of the ANC in Brussels, it is the
first time that I am in South Africa.
1. The topicality of our meeting is evident
considering that Mr. van Walsum, the Special Envoy of the Secretary
General of the United Nations, before his resignation last June,
proposed in his report to the Secretary General in April 2008, to
adopt, not in the name of international law which, he acknowledges, is
in favour of the right to self-determination of the Saharawi People,
but in the name of pragmatism and accomplished facts, a solution, which
he said, was “ realistic” as it dealt with a concept of a
self-governing territory integrated within Morocco.
This proposal, which was nothing else but Morocco’s proposal, was not
taken over by the Secretary General in his report to the Council [1] (24th of April 2008)
nor in resolution 1818 (30th of
April 2008).
Dealing with the conflict of Western Sahara, in October, the 63rd
session of the General Assembly of the United
Nations has reconfirmed the inalienable right of all peoples to
self-determination and independence and has asked the
Special Committee in charge to study the situation
as to the implementation of “the Declaration on the
Granting of Independence to Colonial Countries and Peoples”, to
continue to monitor the situation of Western Sahara
and to submit a report on the matter at the 64th
session.
2. Having said all this by means of introduction, I
would like to continue by recalling that all European colonial
countries evoked their “civilizing mission” to justify their conquest
and colonial occupation. I will limit myself to the exemplary case of
Spain and cite the representative of this country before the 4th
Committee of the General Assembly of the UN on the first of February
1957: “…Portugal and Spain have never been colonial countries nor even
colonizing countries; in fact they have been “ civilizing “ countries,
colonialism as a system of exploitation of wealth and raw material
through the manual labour of the native people, is a concept that
emerged in world history when Spain and Portugal had already fulfilled
their enormous task.
The work of Portugal and Spain was first of all a work of catholic
unity, spiritual and cultural in the same time” .[2]
On the 10th of January 1958, Spain under Franco published a decree
which stated that “the Spanish territories of Western Africa are
composed of the provinces of Ifni and Western Sahara”, this in order to
escape the evolution of international law, concerning colonized
territories.
On the 10th of November 1958, during the 4th Committee session, the
representative of Spain declared: “ Spain does not possess
non-self-governing territories, those submitted to Spain’s sovereignty
are considered as Spanish provinces, in accordance with the
legislation. Consequently, the Spanish government does not consider
itself targeted by article 73 of the Charter of the United Nations
related to non-self-governing territories, those
territories do legally not exist within the Spanish administration”. [3]
Indeed, we ought to recall by virtue of the Charter (Ch.XI) that each
member state of the United Nations that assumes the
responsibility to administer non-self-governing territories has to
respect, within his administration, well defined
obligations particularly within article 73 of the
Charter “to develop the capacity of the populations to administer
themselves and to take into
account their political aspirations” .[4]
A the time, the position of the Franco government at the United Nations
was supported by the whole of western countries.
History will nevertheless agree with the colonized peoples as on the
14th of December1960, the General Assembly of the
United Nations will solemnly adopt resolution 1514(
XV) which specifies the international law of decolonization such as
established by the Charter and the practice of the
United Nations, reconfirmed by the Declaration
on the Granting of Independence to Colonial Countries and Peoples.
This resolution constitutes the real charter of decolonization, says
Professor Pierson- Mathy.
A couple of years later, in 1962, the Committee charged with the
implementation of resolution 1514 (XV) will put
Western Sahara on the list of non-self-governing territories.
If resolution 1514 (XV) is a remarkable move forward of international
law within the United Nations, we ought to remember
that this victory over colonialism is above all the
victory of peoples and the national liberation movements who fought for
their independence.
Let us recall the victory of the Vietnamese against France in 1954; the
success of the Conference of Bandung which created
the alliance of nonaligned countries in 1955, the
nationalization of the Suez Canal by G.A Nasser in 1956, the 50th
anniversary, the 20th of August 2008, of the
beginning of the national liberation war in Algeria,
the assassination of Patrice Lumumba in January 1961.
In 1960, 17 African countries had obtained their independence and had
made their entrance in the General Assembly of the
United Nations.
3. As an active member of the international
solidarity movement with people from the South and in support of the
recognition of their fundamental rights as defined by the Charter of
the United Nations, by the Universal Declaration of Human Rights (we
will commemorate its 60th anniversary within a couple of days), by
humanitarian law, I am shocked and questioned by the regression of the
rule of law in the international reports.
What strikes me, during the last 30 years, is the regression of rule of
law.
Since 1977, with the revival of the Cold War that lead to the fall of
the USSR and to the end of multilateralism, the
United States have been wanting to impose their power as a
system of international regulation, their
military force, with their allies of OTAN, in order to settle conflicts.
In the same time, the United States and their western allies gave to
the big international institutions like the World
Bank, the International Monetary Fund, as well as to
the WTO and to OCDE, the management of the economical and financial
equilibrium of the planet and this to the profit of
the big trade and banking actors of the globalized world.
The efforts deployed by the United Nations in order to alert the
world-wide decision- makers of the risks - the arms
race or the wars, the more and more tragic unbalances between the 2,2
milliard poorest people and the minority of
those who appropriate all the wealth and public goods, the ecological
risks, the violations of human rights- will more and more remain
resolutions without result.
Consequently, the whole edification of the United Nations is put in
danger, in particular as to its capacity to fulfill its mission in
order to guarantee the implementation of the Charter concerning:
- the peaceful coexistence of States
- the right of peoples to self-determination
- the non-interference in the internal affairs of
States
- the promotion of the Universal Declaration of Human
Rights
How many people today are victim of this deregulation and the loss of
credibility and influence of the United
Nations? It is a real crime against humanity that is committed in too
many regions of the planet.
Respectable peoples, as are the Saharawi people and also the
Palestinian people, are among the principal victims
of this disorder and the decline of the rule of law.
Although reprehensible, there is nothing amazing about the fact that in
this context the European Union, and in particular
the European Commission, considers it as normal to negotiate and grant
an “Upgrading» to Israel and Morocco, the
only two countries in the Mediterranean that military occupy another
country, one occupies Palestine, the other Western Sahara.
In theory Europe abstains, but not in reality, from importing products
coming from the Israeli settlements, products that are wrongly labeled
“made in Israel”.
Europe has no scruples about signing a fisheries agreement with Morocco
that includes the Saharawi coastal waters.
I will say it again, without the struggle of the Polisario Front and
the Organization for the liberation of Palestine,
without the solidarity movements, without the support of the
African Union in the case of Western Sahara, the Arab League in the
case of Palestine, but also without the support of
Algeria and South Africa, I don’t think we would be
here, in such good working conditions, to discuss the right to
self- determination of the Saharawi people.
4. What about the international solidarity movement
with the Saharawi people after supporting its liberation movement for
33 years?
The solidarity movement in support of the Saharawi people was initiated
by a number of political militants, unionists,
intellectuals, who had experience with this sort of commitment
with other peoples in Africa, Asia, Latin America, for
instance with the National Front for the Liberation
of Vietnam, the MPLA, the PLO, the Cuban CP and other
revolutionary movements in Latin America who lead a struggle for
independence or against dictatorships. For them the
support towards the Saharawi people was a
continuation of the international solidarity movement in support of the
emancipation of people from colonialism, oppression and imperialism.
In Europe committees were created in Italy, Switzerland, France,
Holland and Belgium, afterwards in Great Britain,
Austria, Germany and Portugal, then joined by more
and more Spanish committees and by Scandinavian committees and
committees in Yugoslavia.
Committees were also created outside Europe, in the beginning in
Algeria, in the United States, in Japan and India and then also in some
African countries and in Latin America.
After the first committees were put in place, it was agreed to hold
coordination meetings on a regular basis aimed at comparing our
actions, enriching our experiences and at giving a
visibility to the struggle of the Polisario Front. That is how the
European Coordination of Committees in Support of Western Sahara-
EUCOCO, who has just hold its 34th meeting in Valencia, in Spain
– was born.
500 participants coming from 25 countries in Europe but also from
Russia, Angola, South Africa, Senegal, Mauritania, Nigeria, Mali,
Uruguay, Chili, Paraguay, Peru and Mexico took part in this
EUCOCO meeting.
The objective of the solidarity committees is to contribute to the
defense of the inalienable rights of the Saharawi
people and therefore develop, within civil society,
actions on three levels:
4.1 Public actions in order to make the demands of
the Saharawi people known to the political decision-makers on a local,
regional, national, continental and international level.
Concretely we have:
• created a solidarity network, active often for 33
years, in order to exercise political pressure, in coordination with
the representatives of the Polisario Front
• created a network of cities and regions that have
twinned or signed friendship’s agreements with Saharawi cities,
represented today in the refugee camps in the region of Tindouf.
• created in a large number of Parliaments in Europe
and in the world Parliamentary intergroups “Peace for the Saharawi
People”, an initiative which was launched within the French National
Assembly in 1985 in the presence of almost 500 parliamentarians coming
from different continents.
• lead actions directed towards big international
institutions such as the United Nations and the EU in order to alert
them about the living conditions of the Saharawi people in the
territories occupied by Morocco and about their duty to bring
assistance to the refugees in the camps close to the Saharawi-Algerian
border.
• alerted the different offices of the United Nations
in the world and participated as petitioners in the 4th Committee of
the General Assembly of the United Nations.
Politically, our objective is to denounce the failure of the
International Community with regard to the inalienable right of the
Saharawi people to self-determination, as defended by the Polisario
Front, the authentic and only representative of the Saharawi people and
as such recognized by the United Nations. But also in defending the
Saharawi Arab Democratic Republic – SADR- announced by the
Saharawi people, represented by the Polisario Front, on 27th of
February 1976. By creating the independent and sovereign state, the
SADR, the Polisario Front complied by fact and law with resolution 1542
(XV) of the General Assembly of the United Nations, which arranges for
such a proclamation to be one of the three ways for a
non-self-governing territory to attain full autonomy.
Today the autonomy of the SADR has been recognized by the Movement of
non- aligned countries as well as by the Organization
of African Unity, the present African Union, and also by more
then 70 countries. The SADR is therefore lawfully a State. Thus the
United Nations are in full contradiction by accepting that the
United States, France, Spain and Morocco stand in the way of the
admission of this State to the General Assembly. Again the same
reasoning can be made for Palestine. Whereas it is the same reasoning
that has lead to the admission of East Timor, as a sovereign state, to
the General Assembly of the United Nations on 27th of September 2002.
The vigilance of the committees, their action towards political parties
in coalition with the leadership of the Polisario
Front in Europe, has enabled us to prevent the numerous attempts of the
successive governments in Morocco to lead astray the Saharawi conflict.
Today not even one country or international organization has recognized
any sovereignty of Morocco over Western Sahara.
In order to enlighten the states and the public opinion on the
legitimacy of the demands of the Saharawi people,
expressed by the Polisario Front, the committees invited the
Permanent Peoples Tribunal to organize in Brussels on the 10th and 11th
November 1979, a session on Western Sahara. They were inspired by
the International Court on War Crimes in Vietnam, presided by
Bertrand Russell in 1966.
Afterwards, numerous initiatives of jurists in international law, till
the one we have today, will confirm the whole rights
of the Saharawi people to their independent State.
During the EUCOCO Conference in Valencia in November 2008, the
participants from 5 Latin American countries have announced the
creation of coordination for the organization of a Latin American
Conference in support of the Saharawi people, which
will take place in Montevideo, in the course of 2009.
The participants have also decided:
• to follow up the elections in the European
Parliament on the 7th of June 2009 and to fight against the renewal of
any Fisheries Agreement between the EU and Morocco that would include
the coastal waters of Western Sahara.
• to participate in the Conference of the UN Durban
II on racism and xenophobia.
• to participate in the World Social Forum in
Belém in Brazil.
• to participate in the work of the Special Political
and Decolonization Committee of the United Nations (Fourth Committee)
in October 2009.
A last example of an action from the European Committees was the
organization of an interparliamentary meeting, in June 2008, in
the French National Assembly; a meeting which was organized with the
support of the socialist, communist and green groups
within the Assembly.
During this meeting, we discussed the actions to undertake to denounce
the upgrading of the agreement between the EU and Morocco.
4.2 An important part of the work of the committees also consists in
providing material, humanitarian and technical support to the Saharawi
refugees and to their organizations of civil society,
women, youngsters, unions, red cross, associations for the defense of
human rights, cultural associations etc..but also to
the different Saharawi ministries in charge of health, education,
agriculture etc…
The solidarity Committees alone are not sufficient to be totally
effective against all the obstacles. They also request the help
of NGO’s, associations and leagues for the defense of human rights,
governmental and intergovernmental agencies, movements of
citizens in order to enable the Saharawi people in the refugee camps
but also the resistance in the occupied territories
and, of late, in the territory controlled by the Polisario Front, to
start proceedings which already foreshadow the construction of the
State of Western Sahara.
Associations of jurists and human rights (AFAPREDESA, BIRDSHO,
CORELSO…) are set up to provide help in the defense
of Saharawi political prisoners, to demand news from
the five hundred disappeared Saharawis, to denounce the facts of
torture and exactions towards the Saharawi members
of the resistance in the occupied territories.
We also need to demand from the UN the expansion of the mandate of the
MINURSO in order to ensure the protection of human
rights in the Saharawi territories occupied by Morocco. An
alternative solution would be the sending, by the Office of the UN High
Commission for Human rights, of a special reporter to the occupied
territories.
In the same way the very active network WSRW (Western Sahara Resource
Watch) was formed a couple of years ago to denounce the
exploitation by Morocco of the Saharawi natural
resources such as phosphates, fish, oil and agricultural products.
It is also all about organizing lobby actions against foreign
companies, which negotiated exploration agreements
with Morocco, in order to discourage them and to stop their involvement
in such illegal activities
4.3 An essential axe of the work of the committees
consists in the promotion and the revival of a successful
communication-network which
guarantees the best visibility of the struggle of
the Saharawi people, in order to ensure a renewed and militant
mobilization, to break through the wall of silence
which surrounds the Saharawi conflict and to
convince the political decision-makers as much as the public
opinion of the just cause of the Saharawi people.
To conclude,
Concluding this intervention, I think that the actions of civil society
and of the committees are more indispensable than ever, taking into
account the historic moment that presents itself in Africa to end the
last colonial situation.
Moreover, to fail would represent the collapse of a whole piece of
international legality in matters of decolonization and the right of
peoples to self-determination.
It is a serious risk for the whole of the African continent; this is
why I am delighted that last June, the Socialist International has
accepted the Polisario Front among its members.
Your work and proposals, as international jurists reunited here in
Pretoria, will make it possible, I hope, to move out of the status quo
in which the Security Council keeps the file of Western Sahara.
Let us hope that the new American administration will decide, just as
the new elected president Obama has committed himself, in favour of
more multilateralism and more respect for international legality.
A touch of optimism to end:
1. I have told you I
was the owner of the house of the ANC in Brussels, a house we bought
for the ANC in 1986 in order to convince Europe to put an end to its
support to apartheid. Today this house is at the disposal of the
representative of Palestine in Brussels. It is in itself a clear
message that if apartheid was overcome, the Palestinians will also gain
their State, Palestine, with East Jerusalem as capital.
2. If today Timor is independent thanks to its
struggle, it is also thanks to the public opinion, the actions of the
solidarity committees and the courageous action of the Portuguese
government. The solidarity of the Spanish people and numerous
independent governments will one day succeed in compelling the Spanish
government to seize its responsibility and give decolonized Western
Sahara its independence.
3. We’re probably at an important turning point for
the whole of humanity.
The arrogance and absolute supremacy of the West are questioned
worldwide.
Its ultra liberal economical model has failed and the peoples in the
world have a right to demand a new model of
international society in order to built, together, new standards which
will guarantee every human being its
fundamental rights and its right to live in peaceful
coexistence with all the other nations on the planet.

internationale dans le soutien à la résolution du conflit
du Sahara Occidental

Je remercie le Ministère des Affaires étrangères
de l’Afrique du Sud, ainsi que l’Université de Prétoria
qui ont pris l’initiative de cette rencontre dont le sujet est d’une
particulière actualité.
Permettez-moi de parler en ma qualité de militant du droit des
peuples à disposer d’eux-mêmes et de vous faire partager
mon émotion, car ayant été durant trois
décennies un militant de la lutte anti-apartheid, étant
encore en titre le propriétaire de la maison de l’ANC à
Bruxelles, c’est la première fois que je me trouve en Afrique du
Sud.
1. L’actualité de notre rencontre est
évidente dans la mesure où M. Van Walsum, l’Envoyé
spécial du Secrétaire général des Nations
Unies avant de démissionner en juin dernier, avait
proposé, dans son rapport au Secrétaire
général en avril 2008, d’adopter, non pas au nom du droit
international qui, reconnaissait-il, est en faveur du droit à
l’autodétermination pour les Sahraouis, mais au nom du
pragmatisme du fait accompli, une solution disait-il «
réaliste », s’agissant d’un concept de territoire autonome
intégré au Maroc. Cette proposition qui n’est autre
que la proposition du Maroc ne fut pas reprise par le Secrétaire
général dans son rapport au Conseil du 24 avril 2008 [1], ni
dans la résolution 1813 du 30 avril 2008.
S’agissant de la question du Sahara Occidental, la 63ème session
de l’Assemblée générale des Nations Unies a pour
sa part réaffirmé, en octobre, le droit
inaliénable de tous les peuples à
l’autodétermination et à l’indépendance et
prié le Comité spécial chargé
d’étudier la situation en ce qui concerne l’application de
la Déclaration sur l’octroi de l’indépendance aux pays et
aux peuples coloniaux de continuer à suivre la situation au
Sahara Occidental et de lui présenter un rapport sur la question
à sa 64ème session.
2. Cela étant dit à titre
d’introduction, je voudrais poursuivre en rappelant que toutes les pays
européens coloniaux ont toujours invoqué leur «
mission civilisatrice » pour justifier leur conquête et
occupation coloniale. Je me limiterai au cas exemplatif de l’Espagne
pour citer le représentant de ce pays devant la 4ème
Commission de l’Assemblée générale de l’ONU le 1er
février 1957 : « …le Portugal et l’Espagne n’ont jamais
été des pays colonialistes, ni même des pays
colonisateurs ; ils ont été des pays «
civilisateurs » en effet, le colonialisme en tant que
système d’exploitation des richesses et des matières
premières au moyen de la main d’œuvre indigène mal
payée est un concept qui a surgi dans l’histoire du monde,
lorsque l’Espagne et le Portugal avaient déjà mené
à bien leur tâche immense. L’œuvre du Portugal et de
l’Espagne fut avant tout une œuvre d’union catholique, à la fois
spirituelle et culturelle » .[2]
Le 10 janvier 1958, l’Espagne franquiste allait publier un
décret établissant que les territoires espagnols
d’Afrique Occidentale se composaient des provinces d’Ifni et du Sahara
espagnol, afin d’échapper, pensait-elle- à
l’évolution du droit international à l’égard des
territoires colonisés.
Le 10 novembre 1958, le représentant de l’Espagne à la
Vème Commission déclarait : « L’Espagne ne
possède pas de territoires non autonomes… ceux qui sont soumis
à sa souveraineté sont considérés comme
provinces espagnoles conformément à la législation
en vigueur. En conséquence, le gouvernement espagnol ne se
considère pas visé par l’art. 73 de la Charte des Nations
Unies qui se rapporte aux T.N.A., lesquels n’ont pas d’existence
légale au sein de l’organisation administrative espagnole
» .[3]
Il faut en effet se rappeler que « en vertu de la Charte (Ch. XI)
tout Etat membre des Nations Unies qui assume la responsabilité
d’administrer des territoires non autonomes est tenu au respect dans
cette administration, d’obligations définies notamment à
l’art. 73 de la Charte parmi lesquelles celle de développer la
capacité des populations de s’administrer elles-mêmes et
de tenir compte de leurs aspirations politiques ». [4]
A l’époque la position du gouvernement franquiste aux Nations
Unies sera soutenue par l’ensemble des pays occidentaux.
L’histoire va cependant donner raison aux peuples colonisés
puisque le 14 décembre 1960, l’Assemblée
générale des Nations Unies va adopter solennellement la
résolution 1514 (XV) qui précise le droit international
de la décolonisation tel qu’il est établi par la Charte
et la pratique des Nations Unies, réaffirmé aux termes de
la Déclaration sur l’octroi de l’indépendance aux peuples
et territoires coloniaux. Cette résolution constitue, dira le
Professeur Pierson-Mathy, la véritable charte de la
décolonisation.
Quelques années plus tard, en 1962, le Comité
chargé de l’application de la résolution 1514 (XV) fera
figurer le Sahara Occidental dans la liste des territoires non
autonomes.
Si la résolution 1514 (XV) est une remarquable avancée du
droit international au sein des Nations Unies, il faut rappeler que
cette victoire sur le colonialisme est avant tout celle des peuples et
des mouvements de libération nationaux qui ont
lutté pour leur indépendance. Rappelons la victoire des
Vietnamiens contre la France en 1954, le succès de la
Conférence de Bandung créant l’alliance des pays non
alignés en 1955, la nationalisation du canal de Suez par G.A.
Nasser en 1956, le 50ème anniversaire le 20 août 2008 du
déclenchement de la guerre de libération nationale en
Algérie, l’assassinat de Patrice Lumumba en janvier 1961. En
1960, 17 pays d’Afrique avaient entre-temps accédé
à leur indépendance et fait leur entrée à
l’Assemblée générale des Nations Unies.
3. En tant que membre actif de la solidarité
internationale avec les peuples du Grand Sud pour la reconnaissance de
leurs droits fondamentaux tels que définis par la Charte des
Nations Unies, par la Déclaration Universelle des Droits de
l’Homme (DUDH) dont on commémore dans les prochains jours le
60ème anniversaire et par le droit humanitaire, je suis
heurté et interpellé par la régression de la
règle de droit dans les rapports internationaux.
Ce qui me frappe depuis 30 ans, c’est une régression des
règles de l’Etat de droit.
Dès 1977, avec la relance de la guerre froide qui conduit
à la chute de l’URSS et à la fin du
multilatéralisme, les USA ont eu pour but d’imposer leur seule
puissance comme système de régulation international, leur
seule force militaire, complétée par leurs alliés
de l’OTAN, pour régler les conflits.
Dans le même temps, les grandes institutions internationales que
sont la Banque Mondiale et le Fonds Monétaire International,
ainsi que l’OMC et l’OCDE, se voyaient confier, par les
Etats-Unis et leurs alliés occidentaux, la mission de gestion
des équilibres économico-financiers de la planète
au profit des grands acteurs marchands et bancaires de la globalisation.
Les efforts déployés par les Nations Unies pour alerter
les décideurs mondiaux des risques encourus par
l’humanité tout entière que ce soit par la course aux
armements et les guerres, les déséquilibres de plus en
plus tragiques entre les 2.2 milliards de la population la plus pauvre
et la minorité de ceux qui s’approprient les richesses et les
biens publics, les risques écologiques, les violations des
droits humains resteront de plus en plus des résolutions sans
effet.
Il en résulte une mise en péril grave de l’ensemble de
l’édification des Nations Unies, en particulier de sa
capacité à remplir sa mission visant à garantir
l’application de la Charte concernant :
- la coexistence pacifique des Etats
- le droit des peuples à disposer
d’eux-mêmes
- la non-ingérence dans les affaires
intérieures des Etats
- la promotion de la Déclaration Universelle
des Droits de l’Homme.
Combien de personnes sont aujourd’hui victimes de cette
dérégulation et de la perte de crédibilité
et d’influence des Nations Unies ? C’est un véritable crime
contre l’humanité qui est perpétré dans de trop
nombreuses régions de la planète.
Des peuples respectables, comme c’est le cas pour les Sahraouis, et
bien sûr aussi pour les Palestiniens, figurent parmi les
principales victimes de ce désordre et du recul de l’Etat de
droit.
Bien que répréhensible, il n’y a rien d’étonnant
dans ce contexte que l’Union européenne, la Commission
européenne en particulier, trouve normal de négocier et
d’accorder une élévation de statut avancé à
Israël et au Maroc, les deux seuls pays du pourtour
méditerranéen qui occupent militairement un autre
pays, l’un la Palestine, l’autre le Sahara Occidental.
L’Europe s’abstient en théorie, mais non dans les faits,
d’importer des produits en provenance des colonies israéliennes
de peuplement, produits labellisés « made in Israël
». Elle n’a aucun scrupule à signer avec le Maroc des
accords de pêche qui englobent les côtes maritimes
sahraouies.
Une fois encore, sans la lutte du Front Polisario et de l’Organisation
de Libération de la Palestine, sans les mouvements de
solidarité, sans le support de l’Union Africaine en ce qui
concerne le Sahara Occidental, de la Ligue Arabe en ce qui
concerne la Palestine, mais aussi sans l’appui de l’Algérie et
de l’Afrique du Sud, je ne crois pas que nous serions ici, dans d’aussi
bonnes conditions de travail, pour discuter du droit à
l’autodétermination du Peuple sahraoui.
4. Qu’en est-il du mouvement de la solidarité
internationale avec le Peuple sahraoui après 33 années de
soutien à sa lutte de libération ?
Le mouvement de solidarité avec le Peuple sahraoui a
été initié par un certain nombre de militants
politiques, associatifs, syndicalistes, intellectuels, ayant une
expérience de cet engagement aux côtés d’autres
peuples d’Afrique, d’Asie, d’Amérique latine, e.a. le Front
National pour la Libération du Vietnam, le FLN
algérien, le Frelimo, l’ANC, le PAIGC, le MPLA, l’OLP, le PC
cubain, et plusieurs mouvements révolutionnaires
latino-américains qui ont mené des luttes
d’indépendance et contre les dictatures. Il s’agissait pour eux
d’inscrire le soutien envers le Peuple sahraoui dans la
continuité du mouvement international de solidarité pour
l’émancipation des peuples du colonialisme, de l’oppression et
de l’impérialisme.
En Europe, des comités virent le jour en Italie, en Suisse, en
France, en Hollande, Belgique puis en Grande-Bretagne, en
Autriche, en Allemagne, au Portugal avant d’être rejoints par de
plus en plus de comités espagnols et par les pays scandinaves et
la Yougoslavie. Des comités se créent hors d’Europe,
très tôt en Algérie, aux Etats-Unis, au Japon, en
Inde et par la suite dans quelques pays d’Afrique subsaharienne et
d’Amérique latine.
Dès la mise en place des premiers comités en 1976, il fut
convenu de tenir régulièrement des réunions de
coordination visant à confronter nos actions, à enrichir
nos expériences et à donner une visibilité
à la lutte du Front Polisario. C’est ainsi que naquit la
coordination européenne des Comités de soutien au Peuple
sahraoui – EUCOCO – qui vient de tenir sa 34 ème rencontre
à Valencia en Espagne. Cinq cents participants venant de 25 pays
d’Europe mais aussi de Russie, d’Angola, d’Afrique du Sud, du
Sénégal, de Mauritanie, du Nigéria, du Mali,
d’Uruguay, du Chili, du Paraguay, du Pérou et du Mexique prirent
part à cette rencontre EUCOCO.
L’objectif des Comités de soutien est de contribuer à la
défense des droits inaliénables du Peuple sahraoui en
développant, au sein de la société civile, des
actions à trois niveaux :
4.1 Action publique afin de faire connaître les
revendications d’un peuple auprès des décideurs
politiques au niveau local, régional, national, continental et
international. Concrètement cela veut dire que nous avons :
• créé
réseau de solidarité qui est actif, souvent depuis 33
ans, en vue d’exercer des pressions politiques en coordination avec les
représentants du Front Polisario
• créé un réseau de villes et de
régions qui ont été jumelées ou ont
signé des traités d’amitiés avec les villes
sahraouies aujourd’hui représentées dans les camps de
réfugiés dans la région de Tindouf
• créé dans un très grand nombre
de Parlements en Europe et dans le monde des intergroupes
parlementaires « Paix pour le Peuple sahraoui », initiative
lancée à l’Assemblée nationale française en
1985, en présence de près de 500
délégués de parlements de différents
continents
• mené des actions en direction des grandes
organisations internationales du système des Nations Unies et de
l’UE, pour les alerter sur les conditions faites aux populations
sahraouies dans les territoires occupés par le Maroc et sur leur
devoir d’assistance aux populations réfugiées dans les
campements proches de la frontière algéro-sahraouie
• alerté les différents bureaux des
Nations Unies dans le monde et participé, en tant que
pétitionnaires, à la IV ème Commission de
l’Assemblée générale des Nations Unies.
Politiquement, l’objectif poursuivi consiste à dénoncer
les manquements de la Communauté internationale eu égard
au respect des droits inaliénables du Peuple sahraoui à
son autodétermination, tels que défendus par le Front
Polisario, authentique et unique représentant du Peuple sahraoui
et reconnu en ce sens par les Nations Unies. Mais aussi à
défendre la République Arabe Sahraouie
Démocratique – R.A.S.D. - proclamée par les
Sahraouis, représentée par le Front Polisario, le 27
février 1976. En créant l’état indépendant
et souverain, la R.A.S.D., le Front Polisario se conformait de
fait et de droit au prescrit de la résolution 1542 (XV) de
l’Assemblée générale des Nations Unies, qui
prévoit que cette proclamation constitue l’une des trois
manières pour un territoire non autonome d’accéder
à la pleine autonomie.
Cette autonomie de la R.A.S.D. est aujourd’hui reconnue tant par le
Mouvement des pays non alignés que par l’Organisation de
l’Unité Africaine, l’actuelle Union Africaine, ainsi que
par plus de 70 pays. La R.A.S.D. est donc un Etat de plein droit. L’ONU
est donc en pleine contradiction en acceptant que les Etats Unis, la
France, l’Espagne et le Maroc fassent obstacle à l’entrée
de cet Etat au sein de l’Assemblée générale. A
nouveau, le même raisonnement peut être fait pour la
Palestine. Alors que c’est ce même raisonnement qui a conduit le
Timor-Est à faire son entrée à l’Assemblée
générale des Nations Unis en tant qu’Etat souverain le 27
septembre 2002.
La vigilance des comités, leur action en direction des partis
politiques, en coalition avec les dirigeants en Europe du Front
Polisario, joint à l’action des pays soutenant le Front
Polisario, a permis d’empêcher les très nombreuses
tentatives des gouvernements successifs du Maroc de dévoyer la
question sahraouie. Aujourd’hui pas un seul pays ou organisation
internationale n’a reconnu une quelconque souveraineté du Maroc
sur le Sahara Occidental.
Pour contribuer à éclairer les états et l’opinion
publique sur la légitimité des revendications du Peuple
sahraoui exprimées par le Front Polisario, les
comités invitèrent le Tribunal Permanent des Peuples
à organiser à Bruxelles une session sur le Sahara
Occidental les 10 et 11 novembre 1979. Ils s’inspiraient ce faisant de
l’exemple du Tribunal International sur les Crimes de guerre au
Vietnam, présidé par Bertrand Russell en 1966 .
Par la suite, de nombreuses initiatives de juristes de droits
internationaux, jusqu’à celle de ce jour, viendront confirmer
l’ensemble des droits du Peuple sahraoui à son Etat
indépendant.
Lors de la Conférence EUCOCO de Valencia en novembre 2008,
les participants originaires de cinq pays d’Amérique latine ont
annoncé la création d’une coordination pour
l’organisation d’une conférence latino-américaine de
soutien au Peuple sahraoui à Montevideo, dans le courant de
l’année 2009.
Les participants ont également décidé
• de suivre les élections au Parlement
européen du 7 juin 2009 et de combattre le renouvellement de
tout accord de pêche entre l’UE et le Maroc qui inclurait les
côtes maritimes du Sahara Occidental
• de participer à la Conférence de
l’ONU Durban II sur le racisme, la xénophobie (Genève –
avril 2009)
• de participer au Forum Social Mondial à
Belém au Brésil
• de participer aux travaux de la IV ème
Commission de décolonisation des Nations Unies en octobre 2009.
Un dernier exemple de l’action des Comités européens fut
de tenir une rencontre interparlementaire, en juin 2008, à
l’Assemblée nationale française avec l’appui des groupes
socialiste, communiste et vert de l’assemblée. La rencontre y
traite notamment des actions à entreprendre pour dénoncer
les travaux de rehaussement (Upgrading), c’est à dire d’accord
privilégié entre l’Europe et le Maroc.
4.2 Une partie importante du travail des
comités de soutien consiste également à apporter
un soutien matériel, humanitaire et technique aux
réfugiés sahraouis et à leurs organisations de la
société civile, femmes, jeunes, syndicats, croissant
rouge, associations de défense des droits de l’Homme,
associations culturelles, etc. mais aussi aux différents
ministères sahraouis chargés de la santé, de
l’éducation, de l’agriculture….
Seuls, les comités de soutien ne suffisent pas pour
être totalement efficaces contre l’ensemble des obstacles. Aussi
font-ils appel à l’aide des ONG, des associations et Ligues des
droits de l’Homme, aux agences gouvernementales et
intergouvernementales, aux mouvements citoyens pour permettre au Peuple
sahraoui dans les campements de réfugiés, mais aussi
à la résistance dans les territoires occupés, et
depuis peu dans le territoire contrôlé par le Front
Polisario au Sahara, de passer les actes qui préfigurent
déjà la construction de l’Etat du Sahara Occidental.
Des associations de juristes et de droits de l’Homme (AFAPREDESA,
BIRDHSO, CORELSO….) se sont constituées pour apporter leur aide
à la défense des prisonniers politiques sahraouis, pour
exiger des nouvelles des cinq cent disparus sahraouis, pour
dénoncer les faits de tortures et exactions à l’encontre
des résistants sahraouis dans les territoires occupés. Il
s’agit là aussi d’exiger de l’ONU qu’elle élargisse le
mandat de la MINURSO (mission des Nations Unies pour le Sahara
Occidental) afin d’assurer la protection des droits de l’Homme dans les
territoires sahraouis occupés par le Maroc. Une solution
alternative pourrait être l’envoi, par le Conseil des Droits de
l’Homme des Nations Unies, d’un rapporteur spécial dans les
territoires occupés.
De même le réseau très actif W.S.R.W (Western
Sahara Resource Watch) s’est constitué depuis quelques
années pour dénoncer au grand public l’exploitation, par
le Maroc, des ressources sahraouies, phosphates, ressources
halieutiques, agricoles et pétrolifères. Il s’agit
également de mener des actions de lobby auprès des
sociétés étrangères qui négocient
avec le Maroc des accords d’exploitation afin qu’elles
abandonnent leurs activités illégales.
4.3 Un axe essentiel du travail des
comités consiste en la promotion et la relance d’une
communication performante qui garantisse la meilleure visibilité
du combat du Peuple sahraoui afin d’assurer une mobilisation militante
renouvelée, de percer le mur du silence qui entoure la question
sahraouie et d’alerter tant les décideurs politiques que
l’opinion publique de la juste cause des Sahraouis.
Pour conclure,
En concluant cette intervention, je pense que l’action de la
société civile et celle des comités, sont plus
indispensables que jamais, compte tenu de l’enjeu historique
que représente en Afrique le fait important de mettre fin
à la dernière situation coloniale. Echouer
représenterait d’ailleurs l’écroulement de tout un pan de
la légalité internationale en matière de
décolonisation et de droit des peuples à disposer
d’eux-mêmes. C’est un risque grave pour l’ensemble du continent
africain, raison pour laquelle je me réjouis de ce que
l’Internationale socialiste ait accepté le Front Polisario parmi
ses membres en juin dernier.
Votre travail et vos propositions en tant que juristes internationaux
réunis ici à Pretoria permettront, je l’espère, de
sortir du statut quo dans lequel le Conseil de sécurité
des Nations Unies maintient le dossier du Sahara Occidental.
Espérons ensemble que la nouvelle administration
américaine optera, comme le président élu Obama
s’y est engagé, à plus de multilatéralisme et
à plus de respect de la légalité internationale.
Une touche d’optimisme pour terminer :
1 . On vous a dit que j’étais le
propriétaire en titre de la maison de l’ANC à Bruxelles,
que nous avions achetée en 1986 pour l’ANC afin de persuader
l’Europe de mettre fin à son soutien à l’apartheid.
Aujourd’hui cette maison a été mise à disposition
de la représentante de la Palestine à Bruxelles. C’est en
soi un message clair que si l’apartheid a pu être vaincu, les
Palestiniens aussi gagneront leur Etat, la Palestine avec
Jérusalem Est pour capitale.
2. Aujourd’hui, si le Timor est indépendant grâce à
sa lutte, c’est aussi grâce à l’opinion publique, à
l’action de comités de soutien et à l’action courageuse
du Gouvernement portugais. La solidarité du peuple espagnol et
de nombreux gouvernements autonomes arrivera un jour prochain à
forcer le gouvernement espagnol à se saisir de sa
responsabilité pour donner au Sahara Occidental
décolonisé son indépendance.
3. Nous sommes probablement à un tournant important pour toute
l’humanité. L’arrogance et la suprématie absolue de
l’Occident sont remises en cause dans toutes les enceintes
internationales. Son modèle économique ultra
libéral a failli et les peuples du monde sont en droit d’exiger
un re-modèlement de la société internationale afin
de construire, ensemble, de nouvelles normes permettant de
garantir à chaque être humain ses droits fondamentaux et
ses droits à vivre en coexistence pacifique avec l’ensemble des
autres peuples de la planète.
